1. General Provisions

These Terms of Use ("Terms") govern the relationship between the operator of the Avarii mobile application ("Provider", "we", "us") and users ("User", "you") regarding the use of the Avarii application ("the App") and the services provided through it.

By installing, registering, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Changes take effect from the moment of their publication in the App or on the website. Continued use of the App after publication of changes constitutes acceptance of the new terms.

2. Description of the Service

Avarii is a mobile application that provides information about planned and emergency utility service interruptions (water supply) in Bulgaria. The App offers the following features:

  • Overview of current and planned outages from water utility companies
  • Subscription to push notifications for specific areas and providers
  • Receiving notifications about new outages in subscribed areas

The App is available for devices running Android and iOS operating systems.

3. Registration and Account

To use the full features of the App, you need to create a user account. By registering, you agree to:

  • Provide accurate and current information
  • Keep the provided information up to date
  • Maintain the confidentiality of your password and access credentials
  • Notify us immediately of any unauthorized access to your account
  • Take responsibility for all actions performed through your account

You can register using an email address and password or through your Google account.

4. User Rights and Obligations

4.1. The User has the right to:

  • Use the App in accordance with these Terms
  • Receive notifications about outages in their selected areas
  • Manage their subscriptions and account settings
  • Delete their account at any time

4.2. The User agrees to:

  • Use the App in good faith and only for personal, non-commercial purposes
  • Not violate the rights of third parties when using the App
  • Not take actions that could harm the functioning of the App
  • Comply with the applicable legislation of the Republic of Bulgaria

5. Prohibited Actions

When using the App, you are prohibited from:

  • Using the App for illegal purposes
  • Attempting to gain unauthorized access to our systems or other users' accounts
  • Distributing viruses, malware, or other harmful code
  • Copying, modifying, distributing, or creating derivative works from the App's content
  • Using automated means (bots, scrapers, etc.) to access the service
  • Overloading or disrupting our servers and infrastructure
  • Circumventing technical security measures of the App
  • Using the App in a manner that could harm the Provider's reputation

6. Outage Information

Information about outages and interruptions is collected from publicly available sources of water utility companies in Bulgaria.

Important:

  • We do not guarantee the completeness, accuracy, or timeliness of the provided information
  • We are not responsible for errors, omissions, or delays in the data
  • We are not an official source – for critical information, please contact your water utility provider directly

The App serves informational purposes only and does not replace official communication channels with utility companies.

7. Push Notifications

By subscribing to notifications, you agree to receive push notifications on your device. You can:

  • Manage your subscriptions from the App's settings
  • Disable notifications entirely from your device's system settings

We do not guarantee the delivery of all notifications due to technical limitations of mobile platforms (Android, iOS) and network conditions.

8. Intellectual Property

The App, including its design, logo, software code, texts, graphics, and other content, is subject to copyright and other intellectual property rights owned by the Provider or its licensors.

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. All rights not expressly granted are reserved.

9. Disclaimer of Warranties

The App and services are provided "AS IS" and "AS AVAILABLE", without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the App will be continuously available, secure, error-free, or virus-free. Use of the App is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We are not liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the App
  • We are not liable for losses caused by inaccurate or incomplete outage information
  • We are not liable for the actions or inactions of third parties, including water utility companies
  • We are not liable for interruptions caused by force majeure circumstances

11. Indemnification

You agree to indemnify and hold harmless the Provider, its employees, partners, and representatives from all claims, losses, costs, and damages (including reasonable attorney's fees) arising from your violation of these Terms or misuse of the App.

12. Termination

We may terminate or restrict your access to the App at any time, with or without cause, with or without notice, including but not limited to violations of these Terms.

You may terminate your use of the App at any time by deleting your account from the settings or uninstalling the App.

13. Data Protection

The processing of your personal data is carried out in accordance with our Privacy Policy, which is an integral part of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria.

All disputes arising from or in connection with these Terms shall be resolved through negotiations between the parties. If an agreement cannot be reached, disputes shall be referred to the competent courts of the Republic of Bulgaria.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
